Scope, Precedence, Definitions
These Terms and Conditions (“Terms”) in the version valid at the time of ordering exclusively govern the legal relationships arising from this offering. Any differing customer terms do not apply; their inclusion is hereby rejected. By placing an order you accept these Terms.
The contract language is German.
1. Formation of Contract
By placing your order, you submit a binding offer to enter into a contract with us. The online checkout has three steps: (1) select the products; (2) enter your customer details, including billing address and any different shipping address; (3) choose your payment method. In the final step you can review and correct all entries (e.g. name, address, payment method, items) before submitting your order by clicking “Buy now”.
Acceptance of your offer: We accept your offer either by sending an order/dispatch confirmation by email, by shipping the goods, or by issuing an invoice. The automatic order-receipt email only confirms receipt and does not constitute acceptance.
2. Storage of Contract Text
After conclusion of the contract, the contract text is stored. You can view your order data and these Terms at any time in your customer account. We will also email you an order confirmation containing all contract details.
3. Retention of Title
Delivered goods remain our property until payment in full of all claims.
4. Prices, Shipping Costs, Return Costs in Case of Withdrawal
4.1 Prices: All prices are final prices and include statutory VAT unless stated otherwise.
4.2 Shipping costs are clearly stated during the checkout process and depend on the selected delivery option and destination.
Reimbursement of outbound shipping costs in the event of withdrawal:
If you exercise your right of withdrawal, we will refund the outbound shipping costs up to the amount of the least expensive standard delivery option offered by us. If you selected a more expensive shipping method (e.g. registered mail), the additional costs will not be refunded. This provision applies only to consumer withdrawals; in cases of warranty claims (defects), the statutory provisions apply.
4.3 Return Shipping Costs in the Event of Withdrawal:
In the event of withdrawal, you bear the direct costs of returning the goods.
Outbound shipping costs/additional costs:
If you withdraw from the contract, we will reimburse the outbound shipping costs up to the amount of the least expensive standard delivery option. Any additional costs resulting from the choice of a different, more expensive shipping method (e.g. registered mail) will not be refunded.
Partial withdrawal:
In the case of partial withdrawal, the outbound shipping costs will not be refunded.
If the goods, due to their nature, cannot be returned by normal post, we will inform you of the applicable return shipping costs prior to the conclusion of the contract.
Returned parcels that are undeliverable or not collected by the customer for reasons within the customer’s responsibility will not be automatically resent.
A reshipment will only take place upon the customer’s request and after prepayment of the applicable shipping costs. Any return fees charged by the carrier are considered additional expenses and must be reimbursed by the customer.
Failure to collect a shipment does not constitute a withdrawal from the contract.
5. Delivery Conditions
5.1 Checkout display (binding): After entering the delivery address and selecting the shipping method, the expected delivery time is calculated and shown before you submit the order. The delivery time shown there is decisive.
5.2 Start of the period: For prepayment, the period begins the day after receipt of payment; for all other methods, the day after contract conclusion.
5.3 Business days: “Business days” are Monday to Friday, excluding public holidays at the place of performance.
5.4 Multiple items / partial deliveries: Where items have different delivery times, we may ship partial deliveries where reasonable at no extra cost. Otherwise the longest delivery time applies to the order.
5.5 Unavailability / delays: If we cannot meet the indicated delivery time for reasons beyond our control (e.g. force majeure, unexpected supplier delays), we will inform you without undue delay; your statutory rights (esp. rescission/refund) remain unaffected.
5.6 Country-specific differences: Delivery times may vary by country/region; please refer to the checkout display for your address before submitting the order.
6. Payment
The following payment methods are generally available in our shop:
Credit card – charged immediately after order submission.
PayPal / PayPal Express – PayPal (Europe) S.à r.l. et Cie, S.C.A.; transaction is executed immediately after order submission.
Sofort by Klarna – immediate charge after order submission; requires online-banking-enabled account.
Google Pay – transaction is executed immediately after order submission.
Apple Pay – requires Safari and Apple Pay; transaction is executed immediately after order submission.
Amazon Pay – Amazon Payments Europe S.C.A.; transaction is executed within one banking day after order submission (banking day = any weekday except Saturdays, nationwide public holidays, and 24/31 December).
Klarna – options subject to successful address/credit check; payment is made directly to Klarna (consumers only).
Prepayment / bank transfer – transfer the amount within 7 calendar days, stating the order number; dispatch after receipt of funds (otherwise the order may be cancelled).
6.1 Affiliate Programme “UPPROMOTE”
The following rules apply only to participants in our affiliate programme, not to end-customer purchases.
(1) Participation. Operated via Shopify app “UpPromote”; adults/businesses may apply; no entitlement to admission; we may decline or terminate participants.
(2) Commission & basis. Percentage of net merchandise value after discounts/VAT/shipping & surcharges; standard 5%; category-specific adjustments possible (e.g. 2–3% high-priced / 6–7% low-priced) with prior notice.
(3) Accrual. Only for orders clearly attributable to the affiliate via link tracking and/or discount code, fully paid, with withdrawal/return/chargeback periods expired.
(4) Billing & payout. Monthly, at the start of the following month; payouts (≥ €10 balance) within 14 days of receiving a proper invoice; by bank transfer or as individually agreed.
(5) Withholding / set-off / negative balance. We may withhold commissions pending chargebacks/fraud review/objections and set off against future claims; negative balances (returns/chargebacks) are offset; further recovery reserved.
(6) Prohibited methods. Misleading claims, spam/unsolicited email, brand/domain/keyword bidding on “SensoryBoost” or confusingly similar signs, deceptive price/discount displays, cookie dropping, incentives contrary to law or platform policies. Breaches/fraud suspicion may lead to immediate termination and blocking of commission claims.
(7) Programme administration. Tracking/attribution/statistics via UpPromote; dashboard access provided.
(8) Changes. We may change terms/commission rates with at least 7 calendar days’ notice for the future; notice via dashboard and/or email.
7. Warranty (Gewährleistung)
Statutory warranty law applies. Where used goods are sold to non-consumers (B2B), the warranty is excluded. For consumers, the limitation period for used goods is one year.
This shortening does not affect claims for damages due to injury to life, body or health, nor claims based on intent or gross negligence.
7.1 Liability
We are liable for damages—on any legal ground—without limitation in cases of intent and gross negligence.
For simple negligence in breaching material contractual duties (duties whose fulfilment enables proper performance of the contract and on which the partner regularly relies), liability is limited to the foreseeable, typical damage at the time of contracting.
The above limitations do not apply to injury to life, body or health, to liability under the Product Liability Act, or where a guarantee has been assumed.
8. Applicable Law
German law applies exclusively. For consumers, this choice of law applies only insofar as it does not deprive them of mandatory protections of the law of the country of their residence or habitual abode.
9. Consumer Dispute Resolution
We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
10. Manufacturer’s Warranty
We offer a voluntary manufacturer’s warranty on mouse pads for the original purchaser: 6 months from the date of purchase.
Covered: ✔ Material or manufacturing defects occurring under normal use.
Not covered: ❌ Normal wear and tear; improper use; external influences (e.g. water, extreme temperatures); improper cleaning; use contrary to care instructions; changes in glide behaviour due to normal use.
No warranty for: ⚠ Glides (replacement mouse feet) & grip tape—subject to natural wear; durability depends on individual usage.
Making a claim: Contact Support@SensoryBoost.de with a defect description and proof of purchase.
Note: This warranty does not limit or replace your statutory rights. Your legal warranty rights remain unaffected.
11. Data Protection
Our Privacy Policy at https://sensoryboost.de/policies/privacy-policy applies and forms part of this contractual relationship (Arts. 13/14 GDPR).
12. Set-off; Right of Retention
You may exercise a right of retention only if your counterclaim arises from the same contractual relationship. Set-off is permitted only with undisputed or finally adjudicated claims.
13. Severability
If any provision of these Terms is invalid, the remaining provisions remain unaffected.
